Followup: 19-year-old Brings Gun on School Bus

We’ve got some new details on the 19-year-0ld man accused of bringing a gun on a school bus in Boise last week.

Tristano Fragomeno faces felony counts of grand theft and controlled substance possession as well as misdemeanor counts of possessing weapons or firearm on school property and resisting arrest.  Fragomeno was removed from a Boise school bus in the early morning hours of 11/9 last week after the bus driver noticed Fragomeno appeared to be under the influence. Police searched him and found a pistol in his bag, as well as Suboxone, a drug used in the treatment of opioid dependance.  He was later found to be in possession of Xanax, which he admitted to taking earlier that morning, and did not have a prescription for.

Here now is the complete Affidavit of Probable Cause filed by responding BPD officers:

“On 11/9 at 7:30a Fragomeno walked onto a Boise school bus near 190 E Front Street in the City of Boise.  The bus was occupied with dozens of adolescent school children on their way to school.  While on the bus, the driver noticed Fragomeno appeared under the influence of something and notified school staff at North Junior High, located at 1105 n 13th Street in Boise.  Staff from North Junior High removed him when the bus arrived and notified law enforcement.

When I responded and contacted Fragomeno in front of the school, his shirt was on backwards, his mouth was so dry that his lips had cracked and started bleeding.  Fragomeno had slurred speech and appeared lethargic.  Based on my training and experience, he appeared to be under the influence of a controlled substance.  While talking with Fragomeno about how he ended up on the bus, i observed he had a blue bag strapped around his body.  When asked to see the bag, name removed it from his person and handed it to me.  With his permission I began looking into the bag and as I did, he stood up and snatched it out of my hands.  With the bag in hand, Fragomeno took off running and officer <redacted> and I tackled him to the ground after about 15 yards.  The handgun was observed in plain view on the ground sticking out of the bag that Fragomeno ran with.  The gun was a Glock 23, .40 cal, loaded with 9 rounds, including on in the chamber.  After running the serial number, it came back stolen out of Boise.  A further search of his wallet revealed 3 strips of packaged Suboxone, which he was unable to produce a prescription for.

While processing him at the Ada County Jail, Fragomeno admitted to me post-Miranda the he had purchased the handgun from someone online and knew that it was stolen, since the bottom serial plate had been scratched up.  Fragomeno said he carried the gun for his protection and knew that he was not allowed to possess it due to his age.  Fragomeno said that he had no intention of harming anyone with the handgun.  While being processed into jail, 1 1/2 white rectangular pills fell from his pants area.  Fragomeno admitted the pills were Xanax and he had taken half a pill that morning.  He did not have a prescription for Xanax.
